General Customer Terms & Conditions

  1. Introduction

    Click Central is an online shopping platform (Platform) that is owned and operated by Click Frenzy Pty Ltd ABN 57 161 066 075, an Australian company, under the trading name Click Central (we, us or our). You can use our Platform to buy a wide range of products from third party retailers and suppliers (Merchants). We connect you to Merchants, who pay us a commission for each order you make on the Platform. While we operate the Platform, when you are buying products on it, you will be transacting directly with Merchants, and we are not a party to these transactions nor responsible for supply of the products to you.

    By using the Platform (and any of our associated websites, apps or social media pages) (together, Click Central), you agree to be legally bound by these terms and conditions (Terms) and our Privacy Policy (in addition to any other terms and conditions that may apply to other websites, apps or social media pages). We may change these Terms at any time, and changes will be posted on the Platform. Any change to these Terms applies only to purchases made, and other use of the Platform, after the change is posted on the Platform. By continuing to use the Platform, you agree to be bound by the Terms as changed from time to time.

    To the extent that Merchants’ own terms and conditions applying to your purchases from them are inconsistent with these Terms, these Terms will take precedence and apply to the extent of the inconsistency.

  2. The Platform

    1. Registration

      You must be a registered member to place orders on the Platform. To register as a member, you must be at least 18 years old and have a current Australian residential address. You will also need to provide us with personal information including your name, address, valid mobile phone number and email address. You are responsible for ensuring this information is up to date at all times. Only one account is permitted per user.

      We may suspend or disable your registration at any time if we believe that you are not using Click Central in accordance with these Terms and in an appropriate or reasonable way (including in accordance with the fair use policy set out below), without giving you any advance notice..

    2. Use of the Platform

      You are solely responsible for the activity that occurs on your account, and you must keep your account login information secure. We are not responsible for any unauthorised activity on your account if you fail to keep your account login information secure. If you suspect or become aware of any unauthorised use of your account, you must notify us immediately and take immediate steps to re-secure your account.

      Other than connecting to Click Central through the Platform, you must not gain or attempt to gain access to the Click Central servers. You agree not to:

      • disrupt, modify or interfere with the Platform and its associated software, hardware and data in any way;
      • copy, modify, add to, adapt, delete or amend any part of the Platform;
      • sell, translate, network, publish, commercialise, rent, lease, assign, transfer, loan, or otherwise distribute all or part of the Platform;
      • reverse engineer, disassemble, or decompile any software forming part of the Platform (unless permitted to do so by law, and then only strictly in accordance with the provisions or terms under which that right is given by such law);
      • use the Platform in a manner that breaches any law or infringes the legal rights of any third party; or
      • copy or download, in a systematic manner, any content from the Platform (other than your own data), or communicate or otherwise distribute such systematically-obtained content.

      We do not warrant that the Platform will be available at all times and without disruption. We may make changes to the Platform or its content at any time without notice.

      The Platform has some links to third party websites. These sites have not been prepared by us and are not under our control. Any third party links are only provided as a convenience and we are not responsible for the content or availability of any of these links.

      You must comply with all applicable laws in connection with your use of the Platform (including laws outside Australia if you access the Platform from any place outside Australia).

      You are responsible for maintaining administrative, physical, and technical safeguards for the protection of the security, confidentiality and integrity of the systems that you use to access the Platform.

    3. Placing orders on the Platform

      Information about products on the Platform is based on material provided by Merchants. We cannot be held responsible for incorrect information supplied by Merchants and you are responsible for making your own enquiries to verify information and assess the suitability of products before placing an order. Due to photographic and screen limitations, some actual products may differ to a small extent in visual appearance from the way they appear on the Platform.

      Any information contained on Click Central constitutes an invitation to treat only and is not an offer by us or a Merchant to supply any products. A Merchant will only supply products once it has accepted your order.

      To order a product, add it to the shopping cart and proceed through the checkout process. You will be required to enter payment information, which, if successfully completed, will lead to a confirmation page (which you can use as a receipt of your order). Once you complete an order (including payment), it will be sent to the Merchant who will confirm whether your order has been accepted or rejected. If the Merchant rejects your order, you will be refunded in full.

      Some products on the Platform (including alcohol) carry an age restriction. If a product you have selected is age restricted, you will be required to confirm that you are an appropriate age to purchase the product. Confirming this means you represent to us and the Merchant that you are of an eligible age and that you are not purchasing the product on behalf of a person who is not the appropriate age. The Merchant may require you to confirm your age upon delivery of your products.

      Please Note:

      Unless otherwise stated, reward programs or special discounts applicable to individual Merchants do not apply to purchases made through Click Central.

    4. Cancelling Orders

      We reserve the right to cancel orders that we believe to have been placed in contravention of our fair use policy below, or to be fraudulent (including where we believe there may have been credit card or a payment related fraud). We may also cancel orders where there has been an error in the listing of the product (e.g. an incorrect price). If we cancel your order, you will be refunded in full.

      Click Central has a “no regrets” policy which allows you to cancel your order (or part of your order) for any reason at any time before the Merchant has dispatched your order. Where you have cancelled your order (or part of your order) under our “no regrets” policy, you will receive a full refund of any payments you have made for that order (or the cancelled part of that order). You will not be able to cancel your order under the “no regrets” policy once it has been dispatched by the Merchant.

    5. Promotions and Offers

      The following additional terms and conditions apply to your use of Click Central-branded promotional coupons on Click Central:

      • Promotional coupons are applicable to all eligible products across the Platform.
      • Promotional coupons are only applicable to new customers unless specified.
      • We reserve the right to amend or cancel promotional coupons without notice at any time prior to the coupons being redeemed.
      • Promotional coupon discounts are applied when the code is claimed or the relevant code is entered at checkout on Click Central.
      • Due to age restrictive products, some products and categories (including alcohol) may not be eligible for promotional coupon discounts.
      • Coupon discounts exclude cost of shipping (if relevant).
      • Only one coupon may be used per transaction on Click Central.
      • Coupons may be used a maximum of one time per customer unless otherwise stated.

      Where you have applied a conditional promotion to an order (e.g. free shipping or a % discount for spending above a certain amount), and the order (or part of the order) has been cancelled or refunded, the terms in this clause will apply.

      You cancel or return the order: where you cancel or return your order (or part of your order) for any reason (including under the “no regrets” policy), conditional promotions will be automatically reversed if the remaining order value no longer qualifies for the relevant promotion and the shipping amount or discount will be deducted from the amount of your refund. However, we may on your request determine that, in the circumstances (including taking into account the reasons for the cancellation or return), you should be entitled to still benefit from a conditional promotion or be able to reuse the promotion.

      The Merchant cancels the order: where the Merchant cancels your order (or part of your order) (e.g. because the Merchant is unable to fulfil your order), conditional promotions will not be reversed (even if the remaining order value no longer qualifies for the relevant promotion).

      Please Note:

      • Unless otherwise stated, reward programs or special discounts applicable to Merchants' websites or physical stores do not apply to orders placed on Click Central.
      • Coupons can not be added to an order retrospectively.
    6. Pricing

      All prices listed on Click Central are in Australian dollars and are inclusive of GST. Please note that prices may be altered on the Platform at any time prior to completion (including payment) of an order, for any reason. Delivery charges may be listed separately.

      International Merchants:

      • Where orders are delivered from Merchants located outside Australia, they may be subject to additional duties or other charges. You will be responsible for paying such duty or other charges and acknowledge that delivery of orders may be delayed where payment of such duty or other charges is required.
    7. Payment

      We will collect payment for products that you purchase through Click Central, and pay the Merchant once you have either confirmed your receipt of the product or the timeframe for you to raise an incident about non-delivery of or a fault in the product (as referred to in clause 3.4 below) has expired.

      We currently accept the following credit cards: Visa, MasterCard and American Express.

      If you pay by credit card, you authorise us to disclose your credit card details to, and obtain information from, any financial institution or credit card issuer to verify the credit card and identification details that you provide to us, and to take any necessary steps to confirm that there is sufficient credit on your credit card account to meet likely charges.

      The name that will appear on your payment account will be Click Central.

      Click Central offers you the option of paying for your products through AfterPay. AfterPay is an external service provider and is not part of or related to us. There are no initial fees applicable to you for using the AfterPay service. Some fees may apply if you default on a payment. For AfterPay’s FAQ’s and full Terms and Conditions please go to Credit criteria and credit checks apply to the use of the AfterPay service. Details of payment schedule will be presented as part of the checkout process. Product Exclusions – Gift Cards, iTunes cards, Gaming Cards and any other products in this category are not able to be purchased using the AfterPay method of payment.

      In order to be eligible to use the AfterPay service you must:

      Click Central offers you the option of paying for your products through Humm. Humm is an external service provider and is not part of or related to us. There are no initial fees applicable to you for using the Humm service. Some fees may apply if you default on a payment. For Humm’s FAQ’s and full Terms and Conditions please go to Credit criteria and credit checks apply to the use of the Humm service. Details of payment schedule will be presented as part of the checkout process. Product Exclusions – Gift Cards, iTunes cards, Gaming Cards and any other products in this category are not able to be purchased using the Humm method of payment.

      In order to be eligible to use the Humm service you must:

      • be over 18 at the time of your purchase.
      • be an Australian resident; and satisfy Humm's permanent job/work requirements; and
      • have a current Australian Driver’s Licence and an Australian debit or credit card. If you do not have either of these, please contact Humm directly at discuss further options.

      Where any payments made to Merchants are made in a currency other than Australian Dollars, we will pay the Merchant based on a market foreign exchange rate on the date of payment and may keep any gains made as an FX margin.

  3. Your Order

    1. Transacting with the Merchant

      When you order a product on the Platform, you are transacting directly with the relevant Merchant.

      GST receipts can be supplied by the Merchant upon request for products ordered on Click Central.

    2. Products

      We are not a retailer of the products sold on the Platform. While we use reasonable commercial efforts to ensure that Merchants are reputable and provide quality products, we are not responsible for the products that they make available for ordering through the Platform or for their delivery of those products. If you have concerns, these can be raised through our complaints process described below.

    3. Delivery of your order

      Delivery times are set by Merchants and therefore vary depending on which Merchant you are buying from. After placing your order, you will be able to track its progress by logging into the Platform which will either display the progress of your order or provide a link to the relevant carrier’s site (on which you can check your order’s progress).

      To ensure successful delivery, you must provide a delivery address where someone will be present during business hours. The Merchant will not be liable for late delivery where attempted delivery has occurred on or before the relevant delivery timeframe.

    4. Non-delivery

      Once you have received a product from a Merchant, you must notify us of receipt through the Platform.

      If you have neither confirmed receipt nor notified us of non-delivery within the time period for acceptance (which is 14 days after we receive tracking details for your product from the Merchant), you will be deemed to have notified us of delivery of the Product.

    5. Returns and Refunds

      Apart from the “no regrets” policy above, Merchants are entitled to adopt and apply their own returns and “change of mind” policies, provided that they comply with the Australian Consumer Law. You should refer to the applicable Merchant's policies to understand your return and refund rights.

      All products sold on Click Central are likely to come with certain guarantees, and associated remedies, that automatically apply and cannot be excluded under the Australian Consumer Law. The Australian Competition and Consumer Commission makes available information about your rights as a consumer, including at If you have any concerns with a Merchant's return and refund policies or any decision by a Merchant about a refund or return, including any inconsistency with the Australian Consumer Law, you should raise these with the Merchant or through our complaints process below.

    6. Issues and complaints with orders

      You must raise any queries, or lodge any complaints, you may have in relation to purchases made on Click Central through our Platform (rather than directly with the Merchant). Once your query or complaint has been lodged, we will liaise with the relevant Merchant as required to resolve your query or complaint. We attempt to respond to queries and resolve complaints as quickly as possible, but we do rely on you to promptly provide all the information needed to do so.

      Our complaints process does not limit or otherwise affect the liability of the Merchant, rather than us, for product-related issues in the event that the complaint is not resolved to your satisfaction. Our complaints process does not affect or replace rights that you may have against the Merchant under the law, including if they have failed to comply with the Australian Consumer Law.

  4. General Terms

    1. Privacy

      We are committed to protecting your privacy. By accessing and using the Platform, you consent to the collection, use, storage, and disclosure of your personal information in accordance with our Privacy Policy, which is available on our website. When making any purchase through the Platform you acknowledge and agree that we may disclose your personal information to the relevant Merchant. Any personal information disclosed to, and used by, a Merchant is governed by that Merchant’s own privacy practices and policies. We accept no responsibility or liability for the privacy practices or policies of any Merchant. You are responsible for ensuring that you are comfortable with how a Merchant will use your personal information before placing an order with that Merchant.

    2. Intellectual Property

      You acknowledge that we are the sole owner or licensee of all intellectual property rights in the Platform. We hold copyright in all content and elements of the Platform. You must not copy, alter or reproduce any of our content or logo, or the Platform (or any part of it), nor permit any person to do so without our prior written consent.

      If you correspond or otherwise communicate with us, you automatically grant to us an irrevocable, perpetual, non-exclusive, royalty-free, world-wide licence to use, copy, display, and distribute the content of your correspondence or communication and to prepare derivative works of the content or incorporate the content into other works in order to publish and promote such content. This may include, but is not limited to, publishing testimonials on our Platform and developing your ideas and suggestions for improved products we provide.

    3. Disclaimer

      To the extent that you acquire services from us as a 'consumer' within the meaning of the Australian Consumer Law, you may have certain rights and remedies (including consumer guarantee rights) that cannot be excluded, restricted or modified by agreement. Nothing in these Terms operates to exclude, restrict or modify the application of any condition, warranty or provision implied by law, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or any other statute, where to do so would contravene that statute or cause any of these Terms to be void (Non-excludable Obligation).

      To the extent permitted by law, our liability in respect of Non-excludable Obligations is limited to the supplying again of any services supplied under these Terms.

      Except in relation to Non-excludable Obligations, and to the extent permitted by law:

      • all conditions, warranties, guarantees, rights, remedies, liabilities or other terms that may be implied or imposed by custom or law are expressly excluded under these terms; and
      • we exclude all liability to you for any for loss of revenue, loss of goodwill, loss of customers, loss of capital, downtime costs, loss of profit, loss of or damage to reputation, loss under or in relation to any other contract, loss of data, loss of use of data, loss of anticipated savings or benefits, or any direct, indirect, consequential, special or punitive loss, damage, cost or expense or other claims for compensation, incurred by you directly or indirectly under or in any way connected with these Terms or the performance or non-performance of these Terms (and whether arising under any statute, in tort (for negligence or otherwise), under any theory of strict liability, or on any other basis in law), and whether or not we have been advised of the possibility of such loss, damage, cost, expense or claim.

      You will at all times indemnify, and keep indemnified, us and our directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses) or liability incurred or suffered by us arising from any claim, demand, suit, action or proceeding by any person against us where such loss or liability arose out of, in connection with or in respect of your breach of these Terms.

    4. General

      If any part of these Terms is found to be void, unlawful or unenforceable then that part will be deemed to be severable from the balance of these Terms and the severed part will not affect the validity and enforceability of any remaining provisions.

      If we do not exercise or enforce any right or provision under these Terms, it will not constitute a waiver of such right or provision. Any waiver of any provision under these Terms will only be effective if it is in writing and signed by us.

      These Terms are governed by, and are to be interpreted in accordance with, the laws of Australia and you and we submit to the exclusive jurisdiction of the courts of Australia.

    5. Alcohol

      Without limiting any other provision of these Terms concerning Click Central's role in transactions with Merchants, Click Central is not party to the sale of any alcohol on the platform and is an agent acting for the seller.

      The contract for sale is between you and the Merchant.

      Customers must be over 18 to purchase age restricted products including alcohol.

      Purchases of alcohol must be signed for by someone over 18 on delivery.

      Click Central coupons are not eligible for purchases containing alcohol.

    6. Fair Use Policy

      All products offered for sale on Click Central, including those on sale, promotion or with any discounts on retail prices, are offered for purchase for personal use only. We reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to be placed for commercial purposes e.g. purchases perceived to be intended for wholesale, or resale.

      We reserve the right to cancel any orders deemed to be in conflict with the above fair use policy. If we cancel your order, you will be refunded in full, and the funds returned to the purchasing account.
